Recommendations for the review of the Foreign Subsidies Regulation

ESMIG welcomes the European Commission’s review of the Foreign Subsidies Regulation.

European companies, including ESMIG members, are increasingly facing unfair competition from third country producers having access to the EU’s internal market. Tackling these issues is essential to safeguard Europe’s critical infrastructure.

ESMIG’s recommendations:

  1. Expand the criteria for ex-ante investigations by including tenders in critical infrastructure sectors, such as smart metering and smart energy systems, and make greater use of ex officio investigations in strategic sectors to address foreign subsidies below the notification threshold.
  2. Strengthen non-price criteria in critical infrastructure tenders by prioritising ESG criteria, critical infrastructure and cybersecurity and supply chain resilience.
  3. Ensure fair competition and reciprocity by safeguarding a level playing field and applying reciprocity principles where needed.
